Some individuals are simply proud to show everyone that they are a graduate of a certain school or institution. They show their pride by displaying a school flag high on a pole in front of their house.

However, problems start to arise when other residents in the area require the person to take the flag down.

Determining the Legal Basis

There are truly laws revolving around the proper display of flags. Specifically, Civil Code section 1353.6

indicates that the display of flags, banners, posters and signs for personal use cannot be asked by a group to be taken down unless these pose a risk or violate laws. Banners and flags should measure up to 15 square feet only, while posters and signs should measure up to 9 square feet only.

Groups cannot ask you to take down your school flag provided that it does not measure more than 15 square feet because it does not violate any law and is not detrimental to public safety and health.

The situation can also vary depending on the kind of flag or sign used. For instance, according to Civil Code section 1353.5, displaying the United States flag is allowed at any time and location. Civil Code section 1353.6 does not give the California state flag the same kind of protection and freedom to be displayed.
